2. ACCEPTANCE OF TERMS

By accessing or using the Site, users fully and unconditionally accept these Terms and Conditions. These terms may be updated at any time. Users are encouraged to consult them regularly. Placing an order implies acceptance of the current Terms and Conditions.

3. PRODUCT AVAILABILITY AND ORDERS

Products are offered subject to stock availability. The seller reserves the right to refuse any order in case of doubt about the buyer’s good faith or in the presence of anomalies (quantity, identity, fraudulent behavior, etc.).

4. PRICING AND PAYMENT METHODS

Prices are shown in euros (€), including all applicable taxes (TTC), excluding delivery charges. Payment is made online through secure methods. Orders are validated only upon full payment receipt.

5. DELIVERY

Deliveries are made by external service providers selected by the seller. Products are delivered to the address provided by the client. Delivery times are indicative. The seller cannot be held liable for delays or loss due to the carrier.

In case of absence, the carrier may leave a delivery notice or follow an alternative procedure.

Once a package is marked as “delivered” by the carrier and/or placed in a secure location (mailbox, concierge, neighbor, pickup point, etc.), it is considered delivered. No refunds will be issued for orders marked as delivered.

6. TRANSFER OF OWNERSHIP AND RISK

Ownership of the products transfers only after full payment. Risk of loss or damage passes to the buyer upon handover to the carrier.

7. RIGHT OF WITHDRAWAL (EU CUSTOMERS)

According to EU Directive 2011/83/EU, private customers located within the European Union have 14 calendar days from the date of receipt to exercise their right of withdrawal.

This right does not apply to opened, sealed or intimate-use items, or to purchases made by professionals or outside the EU.

Returns are at the buyer’s expense and risk. Items must be unused, intact, and returned in their original packaging.

8. LEGALITY AND BUYER’S RESPONSIBILITY

This website is operated by an independent French company and is subject exclusively to French law. All products offered are legal in France.

It is the buyer’s responsibility to verify the legal status of the products in their country of residence before ordering. By confirming the purchase, the buyer acknowledges having verified the legality and accepts full responsibility in case of any legal breach.

Smart Poppers disclaims any liability for seizures, customs blocks, fines, legal actions, or losses related to importing or using products that are banned or regulated in the buyer’s country. No refund will be granted in such cases.

By placing an order, the buyer accepts full responsibility and expressly agrees to this legal disclaimer.

Personal data is processed in accordance with the General Data Protection Regulation (GDPR). Clients may request access, correction, or deletion of their data.

10. INTELLECTUAL PROPERTY

11. APPLICABLE LAW AND JURISDICTION

These Terms and Conditions are governed exclusively by French law. Any dispute will fall under the exclusive jurisdiction of the Commercial Court of Lille (France).
